Franchise Sözleşmesinde Denkleştirme Talebi

Abstract

The subject of this study is the application of the goodwill compensation, regulated in Article 122 of the Turkish Commercial Code No. 6102, to the franchise agreement. In this context, the legal nature of the franchise agreement, its elements, the points of separation from similar agreements, the obligations of the parties and the results of the termination of the agreement are discussed in the first part of the study. In the second part, the subject of the franchisee's right of indemnification is examined in detail. In the last part, the issues of calculation and lawsuit process of goodwill compensation are handled.
