Throughout the history of capitalism, the strike has always been tried to be prevented and limited by political powers. On the other hand, in the period that lasted for almost thirty years after the Second World War; with collective bargaining and trade unions,the strike has functioned as an institution that stabilizes the accumulation regime and the right to strike has been recognized at the constitutional level. In the neoliberal period, these institutions and organizations were subjected to elimination again on a global scale. There has been also a similar transformation in Turkey, since 1980 when neoliberal policies started to implement. In this thesis, the place of law within the social regulation process that makes this transformation possible is questioned. In this context, the transformation of the legal regulations in the neoliberal era in Turkey; it is tried to be interpreted in connection with the transformation observed in structural forms.
