In the analysis of the courts which is about the women and the children in Uskudar Court Records which is the subject of this thesis, we see a lot of the important information about Ottoman law of domestic relations. As we learn in the light of the data we obtain, we have the knowledge of the amount of birth wealth that women have after marriage contract or how much alimony they deserve after divorce and also the custom of women to go after their rights legally which are protected by court records.
The purpose of the introduction part of our study is mentioning about the methodology and scope of the study and also investigating the position of women and children in the Ottoman nation. In the first part the study Uskudar in the period of Ottoman was mentioned. In the second part, the position of women in Ottoman nation was mentioned briefly and then the courts that women involved in Uskudar Court Records were investigated according to the types of crimes. In the last part the study, the notion of child was evaluated and its position in the Ottoman nation was investigated. Later the courts in which children involved in Uskudar Court Records investigated again according to the types of the crimes.
The records which were investigated in this study are the ones which were belong to Uskudar Law Court in 16. cc. Additionally, apart from Uskudar Court Records, also we made use of Istanbul Law Court Records, Balat Law Court Records , Eyüp Law Court Records and the records from Anatolia which were belong to the same period. In the thesis study, by investigating the position of women and children in terms of social, cultural, judiciary and financial in Ottoman nation in 16.cc in the light of Uskudar Court Records, which is the main source, it is aimed that determining the profile of crime of that century and examining the main characteristics of Ottoman Empire’s legal system.
