Abstract
Capital markets are financially significant tools that become prevalent with the influence of contemporary transformation. Particularly, socio-economic transformation, technologic and informatic developments have had a considerable impact on capital markets. Internationalization has also taken effect. A capital market, in addition, constitutes a crucial part of the capitalist economical system.
Capital market pursues the function of capitalist production relations in capitalist economical systems in an easier and less effortful manner through enabling monetizing money.
Turkey, as a developing country, has adopted a legal background on capital markets as a consequence of neoliberal policies in 1980s. The function capital markets integrates in capitalist systems is to derive profit easily and simply without necessity of possessing the production means. Other objective is stated as providing social development and generating employment by collecting the personal short savings. Capital markets pursue the foregoing objectives through the protection that criminal law provides. Crime types specific to capital markets take place in the economical crimes as an important part of criminal law.
Economical crimes serve the lofty aims -national economy, free market economy- as a superior concept influenced by socio-economic transformation.
Trade based manipulation crime as an economical crime type specific to capital markets shall be studied from historical and theoretical perspectives in the light of the foregoing.
