Abstract

Article 193 of the Code of Civil Procedure No. 6100 regulates the evidential contract. In this way, the parties are authorized to choose the evidence or evidence to be used in the proof activity. The purpose of this study, which consists of there parts, is to evaluate the exclusive evidential contract, which is a type of evidential contract. From this point of view, the concept of exclusive evidential contract is discussed togetter with the concepts of evidential contract and non-exclusive evidential contract, and its legal nature, establishment, effects, application, and implementation are explained, and then the arbitrator- expert witness contract, which is a special type of exclusive evidential contract, and the supervision of the exclusive evidential contract within the scope of various legal provisions are discussed. Finally, some areas where the exclusive evidence contract is seen are mentioned.
