Citizenship is the legal and political bond established between the natural person and the state. Citizenship determines the belonging of individuals to a state. However, a citizen's belonging to a state is not unchangeable. States determine the ways in which their nationality is acquired and lost, and whether a person is their own national according to their own national law. The primary regulation regarding the acquisition of Turkish citizenship in Turkish law is promulgated in the Turkish Citizenship Law No. 5901. Pursuant to Article 9 of the Law, citizenship is acquired after birth with the decision of the competent authority, adoption, or the exercise of the right to choose. The acquisition of citizenship by the decision of the competent authority is the acquisition of the citizenship after birth by fulfilling the conditions specified in the laws of the country where the foreigner wishes to acquire citizenship. Extraordinary acquisition of Turkish citizenship is one of the types of acquisition of Turkish citizenship by the decision of the competent authority.
Many states provide foreigners with special qualifications the opportunity to acquire citizenship in an easy way with the regulations promulgated in their citizenship laws. In Article 12 of the Law No. 5901, some foreigners are given the opportunity to acquire Turkish citizenship in an extraordinary way, without seeking the general conditions required for the acquisition of Turkish citizenship by the decision of the competent authority. In our study titled “Extraordinary Acquisition of Turkish Citizenship”, the extraordinary acquisition of Turkish citizenship will be evaluated within the framework of the relevant legislation provisions, and the regulations regarding the extraordinary acquisition of citizenship in comparative law will be examined. In this context, the study will focus on how the individuals who can extraordinarily acquire citizenship are regulated in the legislation and the uncertainties that the regulation may bring forth in practice.
