Otoriteden Otonomiye: Yasa Ve Özgürlük
Özet
This study aims at following and examining the transformation of the relation between law and freedom from the contextual framework in which authority is juridically founded up to the contextual framework in which such relation is rethought in terms of a social autonomy ideal, and focuses on the questions such as “Can we think law without authority?” and “Is social autonomy possible?”. Firstly, it is shown how the relation between law and freedom is constructed through the concept of authority by Hobbes, Rousseau, Kant and Hegel. Attention is drawn upon the point that an authoritarian comprehension of state underlies the background of the modern interconnectedness of law and freedom which can be defined as “juridicalization of freedom”.
