Abstract
Organ and tissue transplantation experimentations date back to hundreds of years have came to a very successful position, especially in the last half century. Following this success of medical science in organ and tissue transplantation, the need for a legal basis for transplantation has arisen. For this purpose, the terms of the transplantation have been regulated by legal orders. At the same time the issue of organ and tissue transplantation has been subjected to many international regulations. The most important of those regulations is the European Convention on Human Rights and Biomedicine. In our study titled "Consent in Organ and Tissue Transplantation" which consists of an introduction, three main parts and a result, organ and tissue transplants will be examined in the frame of consent. In this context, the consent provisions of the Law No. 2238 which was enacted in 1979 and that is the basic regulation on organ and tissue transplantation, will be examined. In order to better understand the deficiencies in that Law, the Biomedicine Convention and the legal regulations of other countries will be mentioned as the subject rises.
