Özet
Interest can be defined as civil benefits to be paid in proportional rates to the debtee in pecuniary debt for the period of time in which the debtee is deprived of his/her depts. The provisions of interest are arranged in Turkish law in a scattered manner. The basic rules related with the origin and rate of interest are included in the Turkish Code of Obligations, Turkish Code of Commercial and the Law No:3095 on the Law on Legal Interest and Default Interest.
Characterization of any transactions as ordinary, commercial or consumer can affect to the provisions of interest. Therefore, the nature of the relationship between parties are need to be determined before implementation of interest provisions.
In this study; differentiation among ordinary,commercial and consumer transactions are examined in the light of doctrinal views and decisions of the Supreme Court.
