This study aims to analyse the liability of employer which is regulated under Article 66 of the Turkish Code of Obligations, Law No. 6098. This strict tort liability means the liability of a person against third persons for damages caused by unlawful acts of his/her dependent auxiliaries during their employment. In this study, the legal nature, functions, historical origins of this liability is examined; regulations under the legal systems of major foreign countries are evaluated with comparative perspective and conditions of this liability is analysed in detail by determining the meaning of basic concepts of this liability in the light of doctrinal and jurisprudential views. Also, the scope of application of this liability is determined by examining its relation with other types of liabilities.
