The legislative branch of government has the authority to legislate law in order to establish regulations for it’s country. However, this process of congressional debate over the creation and amending of laws can be long and tedious. Some areas of immediate concern may need to be regulated more efficiently. Because of this necessity, a government’s executive branch may be granted the power to issue certain laws in order to respond to problems more quickly. On April 16, 2017 a constitutional referandum was held in Turkey. The president was granted the authority to issue presidential decrees through constitutional amendments. Hereby, the president can now regulate some issues firsthand by presidential decree. However, the newly adopted constitutional amendments of 2017 have indicated that the authority of the president to issue presidential decrees has some limitations. As a policing measure, the constitutional court is charged with monitoring how the president uses this authority, according to the constitution. The practice of executive order by the president in the United States is relatively similar with Turkey’s presidential decree. The work in this paper demonstrates the scope of presidential decrees and their limitations comperatively.
