Mandatory vaccination, which is seen as a global health measure, should be evaluated in the context of protecting general health. Mandatory vaccinations, especially in childhood, should also be evaluated in accordance with the custody provisions. In this study, the relationship between the rights and obligations arising from custody and compulsory vaccination will be approached through the concepts of private law.
The subject of this thesis is; under which conditions and to what extent compulsory vaccination can be applied to minors under custody, whether it is possible for parents with custody rights to engage in anti-vaccine attitudes and behaviors, how to resolve legal disputes that may arise from conflict of rights and obligations -arising from the custody relationship- with vaccination practices.
In this study: mandatory vaccination practices, which have become quite controversial especially after the global coronavirus epidemic that started in 2020, the effects of mandatory vaccination on those under custody, the legal issues that may arise in case the holders of the right of custody use their rights arising from this right of custody and the use of their rights in conflict with the mandatory vaccination policies will be evaluated.
