In this dissertation, urban regenetation, the scope of application of which has expended day by day and the legal grounds of which have been elaborated gradually in our country, has been studied. Urban regenetation has been dealt with as a term, and its development both in our country and in the world has further been studied under the light of its historical development. Its principles, actors and methods and normative foundations have also been focused on. Subsequently, determination of buildings under risk, decision making, demolishing and regenerating of buildings that are the most serious intersection of urban regenetation with the private law have been scrutinized in consideration of the Law on Transformation of Areas Under Disaster Risk and Governing Regulations, and the disputes arising from the structures under the risk of collapse have been reviewed in consideration of judicial decisions. Lastly, the restrictions and breaches of property right that arise from the Regulation on Transformation of Areas Under Disaster Risk Act No.6306, during the urban transformation have been analyzed.
