Abstract

Thanks to new technological innovations, the counterfeiting money is increasing and altering from its former concept day by day. It is still posing a considerable threat for state economies and public order. The subject which is examined in this thesis is not only a national security issue but also an international one. Therefore, it prompts the states to cooperate and take measures against counterfeiting money. As an example of the measures, the former Turkish Criminal Code 765 applied to counterfeiting money cases numerous times. However, during the times of the Code, any sufficient studies for the subject were not carried out. Although there are some studies for the subject before the current Turkish Criminal Code 5237, the Codes are differentiating strikingly each other on numerous points and it causes the studies are out-of-dated and inapplicable for reference. Assessment of the crime of counterfeiting money will be an important and original contribution to the literature. In this thesis, doctrinal analysis is employed and the elements of the crime is examined as well as controversial points. Furthermore, the terms, ‘‘counterfeiting production’’ and ‘‘circulation talent’’, who are essential for the subject are discussed. In the thesis, related cases and current examples are examined often and Supreme Court of Appeals of Turkey’s cases are applied at necessary times. Last but not least, the aggravated types of the crime, penalties and the related criminal procedure are examined and discussed.
